Terms & Conditions

These terms are available in English, Spanish and Portuguese. If the versions differ, the English version prevails.

1. Who we are and this agreement

HolyCRM.app ("HolyCRM", "we", "us") is operated by Pablo Gorosito, an individual registered in Argentina as a sole trader (monotributista) under the trade name HolyCRM.

These terms are an agreement between HolyCRM and the church that creates an account (the "church"), and they also apply to every person the church invites to use HolyCRM ("users"). By creating an account or using the service you accept these terms and our Privacy Policy. If you accept them on behalf of a church, you confirm you are authorised to do so. If you do not agree, do not use the service.

2. The service

HolyCRM is a web application for church administration: members, visitors, small groups, ministries, events, serving teams, giving and related tools, plus optional public pages a church can publish (such as a website, a links page, a prayer request form and a giving page). Features may differ between plans, as described on our website.

3. Accounts, roles and sign-in

  • You must give accurate account information and keep it up to date.
  • You can sign in with a password or, if you choose, with your Google account. Keep your password and your Google account secure; you are responsible for activity under your account. Tell us promptly if you think it has been compromised.
  • The church's administrators decide who is invited, which role each person has and what each role can see and do. The church is responsible for those choices and for removing access when someone should no longer have it.

4. The church's responsibilities

  • The church is the controller of the information it enters about people, including sensitive information and information about minors. It is responsible for having a lawful basis for that information (such as members' or guardians' consent), as explained in our Privacy Policy.
  • The church is responsible for the content it publishes on its public pages and for the emails it sends through HolyCRM, including having its recipients' permission and honouring requests to stop receiving them.
  • If the church connects its own domain, it is responsible for that domain and its DNS settings.

5. Acceptable use

You agree not to: try to access another church's data or anyone's account without permission; probe, scan or break our security; disrupt or overload the service; send spam or unsolicited bulk email; store or publish unlawful, infringing or harmful content; use the service to harass or discriminate against anyone; or copy, resell or reverse-engineer the service, except as the law allows.

6. Plans, trial and payment

  • Free trial. Every new church gets the full service free for 30 days, with no card required.
  • Free plan. After the trial, a church that does not pay continues on the Free plan, with the limits shown on our website. Nothing is deleted: records above those limits stay visible but read-only.
  • Paid plan. Prices are in US dollars and are shown on our website and at checkout. A payment covers one month or one year in advance and does not renew automatically: we remind the church's administrators before the period ends.
  • Payment in Argentine pesos. Payments by Argentine bank transfer are processed by our payment provider, and the US dollar price is converted at the exchange rate shown at checkout. Other payment methods may be offered with their own prices or discounts, shown before you pay.
  • End of a paid period. If a period ends without a new payment, the church keeps full access for 7 more days and then moves to the Free plan, as described above.
  • Price changes. We may change prices for future periods. A change never affects a period already paid, and we will announce it on our website before it applies.
  • Invoices. Invoices are issued in Argentina under Argentine tax rules. Any taxes or bank charges in the church's own country are the church's responsibility.

7. Refunds

You may cancel a payment within 10 days of making it and get a full refund, as Argentine consumer law provides for online contracts (the right of withdrawal, or botón de arrepentimiento). After that, payments are non-refundable, except where the law requires otherwise. To request a refund, write to us at the address in section 17.

8. Your church's data

  • The church owns the information it enters. We use it only to provide the service, as described in our Privacy Policy, and we never sell it.
  • The church can export its data at any time, including after moving to the Free plan.
  • Moving to the Free plan does not close the account. If a church asks us to close its account, we delete its data within 30 days (it then disappears from our backups within a further 30 days). Please export anything you want to keep first; deleted data cannot be recovered.

9. Availability and changes to the service

We work to keep HolyCRM available and your data safe, and we keep encrypted backups, but we cannot guarantee uninterrupted service: maintenance and events outside our control can cause downtime. We may improve, change or remove features over time; if we remove a significant feature of a paid plan, we will tell the church's administrators in advance.

10. Intellectual property

HolyCRM, its software, design and brand belong to us. These terms give the church and its users a limited, non-exclusive, non-transferable right to use the service while the account is active. The church keeps all rights to its own content and gives us permission to host and display it only to provide the service.

11. Third-party services

Some features rely on other companies, such as Google for "Continue with Google", our payment provider, and the services a church links to from its pages. Their own terms apply to your use of them, and we are not responsible for services we do not control.

12. Warranty and liability

The service is provided "as is" and "as available". To the extent the law allows, we make no other warranties, and we are not liable for indirect or consequential losses, such as lost data you did not export, lost income or lost opportunities. Our total liability for any claim related to the service is limited to the amount the church paid us in the twelve months before the claim. Nothing in these terms limits any right or liability that the law does not allow to be limited, including rights under consumer protection law.

13. Suspension and termination

A church can stop using HolyCRM or ask us to close its account at any time. We may suspend or close an account for a serious or repeated breach of these terms, or if the law requires it. Unless the breach is serious or urgent, we will warn the church's administrators first and give them a reasonable chance to fix it and to export their data.

14. Changes to these terms

We may update these terms. We will post the new version on this page with a new date and, for important changes, let church administrators know by email in advance. If you keep using the service after a change takes effect, you accept the updated terms; if you do not agree, you can close your account.

15. Governing law and disputes

These terms are governed by the laws of Argentina, without regard to conflict-of-law rules. Any dispute arising from these terms or the service will be brought exclusively in the competent ordinary courts of the Autonomous City of Buenos Aires, Argentina, except where a church's local consumer protection law gives it the right to bring a claim in its own jurisdiction. Before going to court, please write to us so we can try to resolve it together.

16. General

These terms and the Privacy Policy are the whole agreement between us about the service. If any part is found unenforceable, the rest stays in effect. Not enforcing a right does not waive it. These terms are available in English, Spanish and Portuguese; if the versions differ, the English version prevails.
